Terms of Service

These Terms are the agreement between you and GUMLABS PRIVATE LIMITED, a company incorporated in India ("we", "our", "us"), for your use of the Twik apps for Android and iOS, which turn your speech into text (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

Who Can Use Twik

You must be at least 13 years old. If you are under 18, you confirm that a parent or guardian has agreed to these Terms on your behalf.

Your Account

You sign in with Google or Apple. Keep your sign-in secure and tell us promptly if you think someone else has accessed your account. You are responsible for activity that happens under it.

Subscriptions and Billing

Twik has a free tier with a daily dictation limit, and paid plans that remove the limit and add priority processing and other features.

• Mobile plans are billed by Apple or Google through in-app purchase. They renew automatically until you cancel, at least 24 hours before the period ends, in your store account.
• Twik for macOS plans are bought on this website and billed by us through Razorpay. They also renew until you cancel.
• Prices are shown before you pay and may include tax.

We may change plan pricing with at least 30 days' notice to existing subscribers, and may change or retire features. Existing subscribers keep access to what they paid for until the end of their term.

Refunds and Cancellation

Refunds for mobile purchases are handled by Apple or Google under their own policies; we cannot issue them. For macOS plans bought here, you can request a full refund within 7 days of your first purchase, and we refund incorrect or duplicate charges in full at any time. Using the App

Use Twik for your own lawful dictation. Do not:

• use it for anything illegal, or to create harassing, hateful, or deceptive content
• dictate other people's personal information, or confidential material you have no right to share
• try to reverse engineer, resell, or overload the App, or get around usage limits or security
• share your account, or use bots or scripts to access the service

We may suspend or close accounts that break these rules or that we reasonably believe are being used fraudulently.

Your Content

You keep all rights to what you say and to the text Twik produces for you. You grant us only the limited permission needed to process your speech and return your transcription. We do not claim ownership of your content and we do not use it to train models. Our Privacy Policy explains how your voice and text are handled.

Our Rights

The App, including its software, design, and branding, belongs to us and is protected by intellectual property law. We grant you a personal, non-transferable, revocable licence to install and use the App on devices you control, in line with these Terms. You may not copy, modify, distribute, or create derivative works from it.

Accuracy

Speech-to-text is not perfect. Transcriptions are provided "as is", and you are responsible for reviewing your text before you send it or rely on it.

Availability

We aim to keep Twik running well but do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of the App, and may release updates that you need to install for it to keep working.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR NEEDS OR BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 100.

Indemnification

You agree to cover our reasonable losses and legal costs arising from your misuse of the App, your breach of these Terms, or your infringement of someone else's rights.

Ending Your Use

You can stop using Twik and delete your account at any time from the App's settings or by emailing us. We may suspend or end your access if you break these Terms, if the law requires it, or if we discontinue the service. Active subscriptions are cancelled on termination; store subscriptions remain subject to Apple's or Google's refund rules. Terms that by their nature should survive termination will continue to apply.

Governing Law and Disputes

These Terms are governed by the laws of India. Before bringing a formal claim, you agree to contact us so we can try to resolve it informally within 30 days. If that fails, disputes will be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, seated in India and conducted in English, on an individual basis only and not as a class action. Either party may still ask a court for urgent relief to protect intellectual property or prevent unauthorised access.

App Store Terms

For the iOS app: Apple is not a party to these Terms and has no warranty or support obligation for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you, and we, not Apple, are responsible for the App and for any claims relating to it. For the Android app: your purchases and subscriptions are also subject to Google Play's terms, and Google handles their billing and refunds.

Changes to These Terms

We may update these Terms. We will change the date above and notify you in the App of material changes. Continuing to use the App after a change means you accept the updated Terms.

General

These Terms and our Privacy Policy are the entire agreement between us. If any part is unenforceable, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer these Terms; we may transfer them in connection with a merger or sale. We are not responsible for delays caused by events beyond our reasonable control.
